Terms of Service

Agreement

These Terms of Service ("Terms") are an agreement between you and Appcellent Yazılım Hizmetleri A.Ş. ("Appcellent", "we", "us"). They apply to our mobile apps and to appcellent.com (together, the "Services"). By downloading or using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

For apps downloaded from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If it conflicts with these Terms, the Apple agreement takes precedence for those apps.

Who can use the Services

You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you're under the age of majority where you live, you may only use the Services with permission from a parent or guardian.

Your license

We give you a personal, limited, non-exclusive, non-transferable and revocable license to use the Services on devices you own or control, for personal and non-commercial purposes. You may not copy, modify, reverse engineer, resell or distribute the apps, except where the law expressly allows it.

Purchases and subscriptions

• Our apps are free to download. Some features require a paid subscription or one-time purchase.
• Purchases are made through the Apple App Store or Google Play and are subject to their terms. Payment is charged to your store account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel your subscription in your Apple ID or Google Play settings. Deleting the app doesn't cancel a subscription. See how to cancel.
• If a free trial is offered, it turns into a paid subscription when the trial ends unless you cancel at least 24 hours before.
• Prices are shown in the app before you buy and may vary by country. If we change the price of a subscription, Apple or Google will notify you as their rules require.
• Refunds are handled by Apple or Google under their policies. See how to request a refund. Nothing in these Terms limits any right to a refund you have under the law.
• Features available in a subscription may change over time as we improve the apps.

Measurements, estimates and AI

Several of our apps turn your phone's sensors or outside data into readings and estimates. Phones aren't professional instruments, and results depend on your device, its case, its surroundings and how it's used. Results are for general guidance only. In particular:

• Stud Finder detects magnetic metal, such as screws and nails. It can't reliably detect wood, live electrical wires or pipes. Always confirm a location by other means, turn off power where needed, and take care before drilling, cutting or nailing.
• Protractor and other measuring features give approximate values and shouldn't be used where precision matters for safety, construction or medical purposes.
• Decibel Meter isn't a certified sound level meter and isn't suitable for legal, occupational or health compliance measurements.
• Volume Booster can play sound at high levels. Listening at high volume for long periods can damage your hearing and your speakers. Use it at your own discretion.
• TCG Vault shows estimated card values based on third-party market data. They aren't offers to buy or sell, can be out of date and may be wrong. Card identification may be inaccurate.
• AI features, such as creating coloring pages in Colorzy, can produce unexpected or inaccurate results. Review results before you use or share them.

You're responsible for how you use any result. Don't rely on the apps for decisions where an error could cause injury, damage or financial loss.

Your content

Some features let you add content, such as photos. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, process and display it only as needed to provide the feature to you. You confirm you have the rights to the content you add, and that it doesn't break the law or anyone else's rights.

Acceptable use

When using the Services, you agree not to:

• break any law or anyone's rights, including privacy and intellectual property rights;
• upload content that is illegal, harmful, hateful, sexual involving minors, or that you don't have the right to use;
• try to access the Services, our systems or other users' data without permission, or interfere with how the Services work;
• scrape or copy data from the Services in bulk, or use them to build a competing product;
• get around purchase checks, limits or security features.

Third-party services

The Services rely on and may link to services run by others, such as Apple, Google and data providers. We aren't responsible for third-party services, and your use of them is subject to their terms.

Intellectual property

The Services, including the apps, designs, text, graphics, logos and software, belong to Appcellent or our licensors and are protected by law. These Terms don't give you any rights to our trademarks. If you send us feedback or ideas, we may use them without any obligation to you.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services will always be available, error-free or that results will be accurate.

Some countries don't allow certain warranties to be excluded. In those countries, these exclusions apply only as far as the law allows, and your statutory consumer rights are not affected.

Limitation of liability

To the maximum extent permitted by law, Appcellent and its directors, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Services or reliance on any result.

To the maximum extent permitted by law, our total liability for any claim related to the Services is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intentional misconduct, or any other liability that can't be limited under the law.

Indemnity

If you use the Services in breach of these Terms or the law and that leads to a claim against us, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

Suspension and termination

You can stop using the Services at any time by deleting the apps and cancelling any subscription. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we have to for legal reasons. We may also change or discontinue an app or feature. If we discontinue an app with an active paid subscription, you may be eligible for a refund under the store's policy. Sections that by their nature should survive will continue after termination.

Changes to these Terms

We may update these Terms from time to time. We'll post the new version here with a new date at the top, and if a change is significant, we'll give you reasonable notice. If you keep using the Services after a change takes effect, you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Bursa have jurisdiction over any dispute, unless the law gives you the right to bring a claim elsewhere.

If you're a consumer living in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you keep the protection of those laws and may bring a claim in your local courts. Consumers in Türkiye may also apply to Consumer Arbitration Committees and Consumer Courts within the limits set by law.

Before starting a formal dispute, please contact us so we can try to resolve it informally.

General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a right, that doesn't mean we've waived it. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Services.
